Government Incentives for Photovoltaics
The European Union as well as federal, state and local governmental bodies in many countries, including
Germany, China and the United States, have provided subsidies in the form of feed-in tariffs, rebates, tax
write-offs and other incentives to end-users, distributors, system integrators and/or manufacturers of
photovoltaic products to promote the use of solar energy:
European Union
Legislation for the promotion of renewable energy sources in the member states of the European Union is
based on numerous European regulations, especially the Directive of 27 September 2001 on the promo-
tion of electricity produced from renewable energy sources in the internal electricity market (2001/77/EC)
which has been partly amended by and will be repealed as of 1 January 2012 by the directive 2009/28/EC
which has to be implemented by 5 December 2010. According to this Directive, each member state
should increase its use of renewable energy solutions such as solar, wind or hydro in an effort to increase
the share of energy from renewable sources within the EU from 8.5 % today to a 20 % share in the EU’s
gross consumption of energy by 2020.
Currently the European Union has taken no actions to harmonise the various promotion systems actually
in place throughout Europe. In its Renewable Energy Progress Report (COM (2009) 192, 24 April 2009),
the European Commission explains that while growth rates of renewable energy solutions have increased,
Europe is far from reaching its 2010 renewable energy targets. Two of the main 2010 goals are to double
the European Union's renewable energy share to 12 % by 2010 and to reach an amount of 21 % for elec-
tricity from renewable energy sources. The European Commission has set up a European Strategic Energy
Technology Plan in 2007 (COM(2007) 723, 22 November 2007) which includes an initiative on the re-
search and further development of photovoltaic technology and concentrating solar power technologies
over the next ten years.
The German system of promotion of renewable energies is a feed-in tariff system that is primarily gov-
erned by the German Renewable Energy Law (Erneuerbare-Energien-Gesetz – “EEG”) of 2010. The
feed-in tariff is binding and guaranteed for a period of 20 years. The guaranteed price for the fed in solar
power of photovoltaic units erected after January 1, 2010 decreases from year to year to encourage more
efficient production of renewable energy. Recently, the German legislative bodies passed an amendment
to the EEG which prescribes a two-step reduction of the feed-in tariffs on new solar systems. In the first
step the feed-in tariffs for solar systems which are put into operation after 30 June 2010 will be cut by 3
% and, in a second step, by another 3 % for solar systems which are put into operation after 30 September
2010.
Recently also other countries in the European Union have announced or already enacted cuts of their gov-
ernment subsidies for solar power generated electricity, such as, inter alia, Spain and France.
USA
In the United States of America, interest in solar power has grown in recent times along with concerns
over greenhouse gas emissions, climate change, rising energy costs in the future and the upcoming
awareness of the finite nature of fossil energy sources. While there are multiple programs at the federal,
state and local levels to support and promote energy generation through solar systems, there are also mul-
tiple regulations AEG PS Group has to comply with. The major regulatory issues related to solar power
include how a solar power system is connected to the grid, how solar-generated electricity is banked on
the grid, which is certified to install solar power and who can allow or prohibit solar power installations
on a residential site.
